Request Summary: A record of the border agreement between Canada and the United States (U.S.) in response to COVID-19 which allows for the mutual return of refugees who cross the border irregularly. Additionally, any other notes or information which describes the nature of the agreement, inclusive of any and all assurances provided by the US and Canada regarding the treatment of asylum seekers upon being returned after an irregular crossing. Further, records of any policy manuals or instructions on whether a written decision is provided to those who are returned to the U.S. under the authority of the Orders in Council (OIC-11). Also, records regarding the procedures that are followed to ensure that these removals are conducted in a procedurally fair manner, including information on how decisions are recorded and how they are communicated to the concerned individual. Finally, any records regarding whether the decisions are communicated to the client in such a way that the decisions can be challenged in Federal Court.
