In 2018, Laurentian Bank of Canada ("LBC") repurchased mortgage loans that it allegedly had inadvertently insured and sold into Canada Mortgage and Housing Corporation’s (“CMHC”) securitization programs. LBC’s repurchased mortgage loans represented a total dollar amount of 223M$. We seek to understand the greater context within which those repurchases fit into CMHC’s securitization activities, inclusive of those of Canada Housing Trust (“CHT”). Thus, we hereby request, under the Access to Information Act, information concerning CMHC’s securitization activities under both the National Housing Act Mortgage-Backed Securities (“MBS”) and Canada Mortgage Bonds (“CMB”) programs. For greater clarity, each request where CMHC’s activities are concerned shall include those of CHT as well. Likewise, each requests concerning MBS activities shall concern both of CMHC’s aforementioned programs. More specifically, we request the following information: 1.Copies of ineligible loan repurchase initial requests (via email, letter, etc.) sent to issuers by CMHC in 2017 and 2018; 2.Copies of advance notices of ineligible loan repurchases (via email, letter, etc.) sent by issuers to CMHC in 2017 and 2018; 3.Copies of reports prepared by CMHC regarding loan sample reviews conducted in 2017 and 2018. Should the identity of an issuer need to be protected by CMHC, we request that the information be provided in an anonymized manner. Please note that we prefer to receive the relevant documents in electronic form, if possible.

The Treasury Board of Canada Secretariat (TBS) issued a Privacy Implementation Notice requiring institutions to establish procedures to validate the identity of requesters. This Notice states that institutions responding to requests for personal information should be reasonably assured of the identity of the person requesting, so that personal information is only disclosed to that individual. There a section of the notice that states “If the request is coming from an individual other than the individual to whom the information pertains, the institution must verify both the identity of the requester and the individual, as well as the validity of the authorization of the individual to have that third party make the request on their behalf.”. It is up to each institution to assess and mitigate the risks of privacy breaches. With regards to the above Privacy Implementation Notice, please provide copies of correspondence between OIC and CBSA ATIP with regards to CBSA ATIP's strategy to handle non compliance by requesters.

Deputy Commissioner, Legal Services and Public Affairs; b. Deputy Commissioner, Corporate Services, Strategic Planning and Transformation Services; and, c. Deputy Commissioner, Investigations and Governance. Please provide records providing the rationale as to why the Information Commissioner (past or present) elected to appoint Deputies under the current (or predecessor) TBS Policy on the Management of Executives as well as the Directive on Executive (EX) Group Organization and Classification and in so doing a) purposely bypassed a statutory authority provided by subsection 56(2) of the Act; b) and, in so doing, elevated the rank and status of such "Assistant Information Commissioners" to that of "Deputy Information Commissioners.' For each of the three positions of Deputy Information commissioners, please provide copy of records which were approved by the Information Commissioner (past or prevent) for the creation and classification of each of the above listed positions classified in accordance with the TBS Policy on the Management of Executives as well as the Directive on Executive (EX) Group Organization and Classification.
