In the recently released Report from the Ministerial Panel for the Trans Mountain Expansion Project, the Panel states at p.3: In preparation for the public meetings, the panel had direct briefings from the proponent, Trans Mountain Pipeline ULC; from the NEB; and from Alberta Premier Rachel Notley, Trans Mountain, whose staff members attended all public sessions, also submitted a series of issue sheets to the panel’s online portal, addressing questions that had been raised during public sessions. This request is for the following records: - All records, including but not limited to; briefing documents, meeting minutes, meeting notes, and correspondence related to the Ministerial Panel’s: Briefing s with Trans Mountain Pipeline ULC, Kinder Morgan Canada and any Kinder Morgan Inc. affiliate; Briefings from the NEB; and Briefings with Alberta Premier Rachel Notley and the Alberta government; - All issue sheets submitted by Trans Mountain referenced above.

Any and all communications from December 1, 2021 to February 28, 2022 to or from the CER employee or contractor named "Tyler" who Claudia Astudillo and Thushanthi Senadheera said was working on Trans Mountains application to reroute its pipeline under the Fraser River. Claudia and Thushanthi's statements about Tyler are contained in memos provided to me earlier under Accees Request A 2021-00029. To be clear, I would like to see as much as possible of Tyler's communications during that 3 month period, not just records which have titles or subjects lines about Trans Mountain's Fraser River deviation because there may be comments about the Fraser River deviation in other memos with different headings. Any and all records of Claudia Astudillo and Thushanthi Senadheera from December 1, 2021 to January 31 2022 concerning Trans Mountain's Fraser River deviation. Any and all communications to and from Tyler about reviewing his files for records relevant to my earlier Access Request A-2021-00029. Any and all communications to and from other CER staff to review Tyler's files with regard to Access Request A-2021-00029.

When referring to page numbers below, I mean the pages in the Client Package disclosed under A-2022-05111. Specifically, I would like to request the following: 1. The "Board deck" (presumably a PowerPoint presentation) mentioned on pages 21-27. 2. The powerpoint attached to the email on page 47, which apparently deals with discrepancies between dTCC data. 3. The media lines attached to the email on page 95. 4. The excel sheet attached to the email on page 98. 5. The presentation attached to the email on page 135. 6. Both attachments to the email on page 135, plus the two documents that are linked to in the email: the impact estimates and communication plan. 7. The attachment to the email on page 142. 8. The "Key messages" document linked to in the body of the email on page 145. 9. The Excel file attached to the email on page 165. 10. I would like any contextual documents related to the document which appears on pages 359-360 ("Brochure: 2020 Rent Increase Guidelines). I imagine this was an attachment to an email, in which case I would like the email (possibly pages 4368-4369 of the raw request). I would also like to request any other documents related to how the brochure was located by the PMPRB, or what use was made of the Brochure by the PMPRB (like subsequent email discussions or meeting agendas which list this document, or reports or memos written about this document, etc). In each case, I would like the most recent or final version. I do not need drafts. Please exclude cabinet confidences.

In all of the requests below, “draft guidelines” refers to the PMPRB Guidelines that were published for comment on October 6, 2022, or any prior drafts or versions of those 2022 Guidelines (for example, if a draft version was circulated to Health Canada for comment in September 2022, it would be part of the “draft guidelines” for the purpose of this request). • Emails or other communications from Health Canada commenting on the draft guidelines, and that were sent between July 1, 2022, and October 6, 2022. • Emails or other communications from the Board members or Board Chair commenting on the draft guidelines, and that were sent between July 1, 2022, and October 6, 2022. • Any training presentations, training manuals, or summaries of the new guidelines prepared for use by the Board Staff, Board, or other governmental departments prepared between July 1, 2022, and October 6, 2022. • Any documents with calculations of how much prices will decrease under the draft guidelines, or under alternative pricing rules, and that were prepared between January 1, 2022, and October 6, 2022 (note the change in date relative to other requests). • Any documents comparing prices or price reductions under the draft guidelines and the old PMPRB Compendium of Guidelines and Procedures. • Any documents, including legal memos, on the compliance of the draft guidelines with legal decisions about the PMPRB, including Alexion Pharmaceuticals Inc. v. Canada (Attorney General), 2021 FCA 157, Merck Canada c Canada, 2022 QCCA 240, and Innovative Medicines Canada v. Canada (Attorney General), 2020 FC 725. • Any documents which discuss how a medicine’s therapeutic class and comparator products will be established under the draft guidelines. • Any documents showing how the Board Staff arrived at the exact pricing tests discussed in paragraph 33-35 of the draft Guidelines. • Any documents which discuss how Board Staff will assess whether a price is excessive *after* an investigation has been opened. For context, the backgrounder which accompanied the draft guidelines suggested that staff will consider “the totality of the circumstances surrounding the price of the medicine, through the lens of the section 85 factors.
